WHATABURGER PRIVACY POLICY

This Privacy Policy (“Privacy Policy”) describes how Whatabrands LLC and its affiliates and subsidiaries (collectively, “Whataburger”, “we”, “us”, or “our”) collect, use, disclose, and otherwise process Personal Information, including in Whataburger restaurants that are owned and operated by Whatabrands LLC; on whataburger.com, stories.whataburger.com, shop.whataburger.com, or any other authorized websites (each, a “Website”); on Whataburger mobile applications (each, a “Mobile App”); through other Whataburger online services, tools, or programs where this Privacy Policy appears; and over the phone or via fax (collectively, the “Services”).
Whataburger may modify this Privacy Policy from time to time, as indicated by the effective date at the top of this Privacy Policy. Your continued use of the Services constitutes acceptance of any such changes. To ensure that you are aware of current privacy practices, we recommend that you review the Privacy Policy periodically. If you do not agree to the modified Privacy Policy, please do not use the Services.
Some of our restaurants are owned and operated by franchisees, who are independent third parties. This Privacy Policy does not apply to our franchisees or to websites these franchisees operate. Please see our franchisees’ privacy notices for information on how they process Personal Information.
This Privacy Policy applies only to Personal Information collected in connection with your use of the Services. Please note that not all of the features and functionality described in this Privacy Policy are available on or through each portion of the Services.

1. Personal Information Collection
“Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a specific person. Personal Information includes information that you voluntarily provide to us when you sign up to use one or more of our Services, send an e-mail, ask a question, offer an opinion, order items in the online store, or fill out a form on our Website; information that we obtain automatically when you access our Websites, Mobile Apps, or other platforms; information we obtain from our service providers, processors, advertisers, social media platforms, and other vendors (“Suppliers”); and information we obtain from other third parties. Personal Information includes, but is not limited to:
- Identifiers and personal records, such as your name, age, address, telephone number, e-mail address, birth date, financial, and/or demographic information.
- Commercial and transaction information, including information about the products you buy, prices, method of payment, and payment details.
- Account information, such as your username or password (or anything else that identifies you) used to access our Services or to buy or use our products and services.
- Internet or other electronic network activity information, such as your Internet Protocol (IP) address; information about the device you are using, including the unique device identifier or mobile equipment identifier for your mobile device, device operating system and browser type, and type of mobile device; the address of a referring website (if any); and activity related to how you use our Services, such as the pages you visit on our Websites or in our Mobile Apps, your search history, and information about your interactions with advertisements.
- Geolocation data, such as your location inferred from your IP address or your precise geolocation as described below.
- Other Personal Information you choose to give us when you interact with us, such as the content of your communications.
- Inferences drawn from any of the categories of information above, such as profile information, including products and services you like, or times you prefer to visit us.
The types of Personal Information we collect about you may not include all of the examples above, depending on how you interact with the Services. See the “Cookies and Other Tracking Technologies” section for additional information regarding our use of cookies and other tracking technologies.
Our Services may collect precise geolocation information about the exact location of your mobile device or computer using geolocation and technology such as GPS, Wi-Fi, Bluetooth, or cell tower proximity. For example, if you use the Mobile App to find the Whataburger location nearest to your current location, Whataburger and its providers will monitor your geolocation to deliver that information to you. For most mobile devices and computer systems, you are able to withdraw your permission for us to collect this information by using the device or web-browser settings. Please note that some functionality within the Services may not be available or may not fully function if you turn off geolocation services. For example, without geolocation services turned on, Whataburger will not be able to determine the closest Whataburger location to you.
We may collect your information from our third-party vendors that you have your own relationship with. For example, certain Whataburger locations will let you use vendor services to engage with Whataburger, including vendors that may process your vehicle’s license plate number when you utilize our drive-thru lanes and communicate your associated contact information to Whataburger. We may combine information from these vendors with other information about you, including the name and method of payment stored in your account.
We may collect information about you when you interact with us through social media. If you link your social media account or engage with Whataburger on social media platforms, you understand that you may be allowing us to have ongoing access to certain information stored on those social media networks (e.g., your public profile, friend list, people you follow or who follow you, your e-mail address, birthday, work history, education history, interests, current city, website, personal description, and likes, and your friends’ birthdays, education histories, personal descriptions, and likes). We may receive certain information about you which is stored on social media networks if other users of those networks give us access to their profiles and you are one of their friends or connections depending upon your settings on those third-party social networking platforms. We may also receive other information (e.g., content viewed and information about the advertisements within the content you have been shown or may have clicked on) from your interaction with our social media pages. The information we have access to from the third-party social media networks varies by network and is controlled by your privacy settings and selections on the social media networks. The information that may be passed to analytics providers and advertising partners is collected using cookies and other tracking technologies. By associating an account managed by a third party with your MyWhataburger Account and authorizing us to have access to this information, you understand that we may collect, use, and store information from such third-party account in accordance with this Privacy Policy.
If you choose to receive text messages from Whataburger, we may collect and use your mobile phone number and consent status to send you messages related to applications, recruiting updates, interview scheduling, sales, coupons, order updates, and other communications.
We may combine your Personal Information with other information we obtain about you, which may include data we obtain from third parties. We reserve the right to convert, or permit others to convert, your Personal Information into deidentified or aggregated data, as permitted by law.
2. Personal Information Use
Whataburger may use information about you for purposes described in this Privacy Policy or disclosed to you within our Services, including to:
- Process and manage your purchase and use of Whataburger products and services, including your accounts, program participation, and payments.
- Respond to your customer service inquiries, post your comments or statements on any blog or other online forum maintained on our Services, or take other actions in response to your inquiries or other Services activities.
- Communicate with you about or fulfill your orders or purchases, your services, accounts and program participation, a contest or sweepstakes you have entered, your requests for information, and about our brands, products, events or other promotional purposes, including co-branded offers and partner offers.
- Operate, maintain, manage, fulfill, and improve our service offerings and provide services such as technical support.
- Improve the design and content of our Services and to enable us to personalize your Internet experience.
- Administer our systems and operate our business.
- Analyze Website and Mobile App usage.
- Offer products, programs, or services to you or other users like you.
- Protect against, identify, and prevent fraud and other crime, claims, and other liabilities.
3. Personal Information Disclosure
We may disclose the categories of Personal Information we obtain about you (as described in the “Personal Information Collection” section above) to the parties listed in this section.
We may disclose Personal Information to our affiliated companies and joint marketing partners. We also may disclose Personal Information to our vendors and other entities to perform services on our behalf, such as technology and communications providers, payment processing and billing service providers, advertising and marketing service providers, and others.
We also may disclose Personal Information if: the disclosure will enable that party to perform a business, professional, or technical support function for Whataburger; the disclosure will enable us to facilitate payments; the disclosure will enable us to prevent or mitigate fraud; or we are required to do so by law. We will also transfer or otherwise disclose Personal Information in response to judicial process, to comply with legal requirements, and, as permitted under provisions of law, to provide information to law enforcement agencies or in connection with an investigation on a matter related to public safety. We may also process your Personal Information as permitted by law to protect our rights or property, the Services, or its users.
We do not share or otherwise disclose opt-in consent data for our text message programs with any third parties for those third parties’ own marketing purposes.
We may disclose Personal Information to other business entities in connection with the sale, assignment, merger or other transfer of all or a portion of Whataburger’s business or assets to such business entity (including in negotiations of such transaction or due to a sale in connection with a bankruptcy or dissolution).
We disclose information to our Suppliers to engage in analytics, analysis, auditing, measurement, research, and reporting, which may be based on Personal Information collected over time, such as through your participation in Whataburger programs, your activity on the Services, your device’s geolocation (which may include specific longitude and latitude, as permitted by law), and your activity on unaffiliated third-party sites, mobile apps, or other online services. To the extent we disclose Personal Information obtained through our Mobile App to our Suppliers, we require that they provide the same level of Personal Information protection as required by this Privacy Policy.
4. Cookies and Other Tracking Technologies
We and our Suppliers may use cookies, pixels, SDKs, and other similar online tracking technologies (collectively, “Cookies”) to collect information when you interact with the Services. These Cookies may collect usage information (such as the browser you are using, IP address and device identifier, length and time of visit, and pages visited); geolocation data (to deliver content based on your location); and details about how you interact with the Services. Whataburger and our Suppliers may use Cookies for various purposes, including to recognize visitors to our Services, determine the number of visitors to or users of the Services and ascertain which pages they visit, personalize user experiences, store user preferences and settings, enable users to sign in, analyze how the Services perform, deliver and tailor interest-based advertisements, develop inferences about you and your interests, combat fraud, effectuate more efficient log-in for users, track transaction histories, preserve information between sessions, improve the functionality of the Services, and fulfill other business purposes. We may associate information we collect via Cookies with the Personal Information we collect from other functionalities of the Services. In some cases, your device must accept Cookies in order for us to complete the service or transaction you are requesting.
We may engage certain web analytics services (including Google Analytics and the Meta Pixel) to help us understand and analyze how visitors use the Services, help us administer and improve the quality of the Services, and serve ads on our behalf across the Internet. We have implemented Google Analytics Advertising Features such as remarketing with analytics, interest-based advertising, demographics and interests reporting, user segment analysis, and impression reporting.
In certain circumstances, we may collect information (including clicks, cursor movement, scrolls, and keystroke activity) to help us analyze activity on our Services, our chat functionality, and Mobile Apps as applicable, through session replay technologies to help us understand and analyze how visitors use our Services, and to improve the Services. These technologies may collect the following types of information, among others: IP address; screen size; device type (unique device identifiers); browser information; geographic location; and preferred language.
We also may use social media technologies to conduct marketing campaigns. To change your privacy and advertising settings with a social media company, log in to your social media account and follow the instructions provided by the social media company.
You can adjust the settings in your browser or on your mobile device in order to restrict or block Cookies that are set by the Services, including to opt out of certain interest-based advertising. Depending on your device settings, you may also opt out of certain interest-based advertising through the device’s “Limit Ad Tracking” or equivalent feature. Refer to your device for more information on what this opt out affects. Your web browser may have settings that allow you to transmit a “Do Not Track” signal when you visit various websites or use online services. - Digital Advertising Alliance and Network Advertising Initiative: To opt out of interest-based advertising from companies that participate in the Digital Advertising Alliance or Network Advertising Initiative opt-out programs, please visit https://thenai.org/how-to-opt-out/.
Your opt out choice may apply only to the browser or device you are using when you opt out, so you should update your settings on each of your browsers and devices. If you opt out, you will still receive ads, but they may not be as relevant to you and your interests.
We do not control how third parties manage their opt out processes. We are not responsible for the effectiveness of external parties’ opt out options or programs, or the accuracy of their statements regarding their programs.
We or our Suppliers may collect Personal Information about your online activities over time and across different devices and online properties when you use the Services.
5. Marketing Communications and Advertisements
Whataburger may make personalized marketing messages, ads, or offers to you through the Services, including our Mobile App, based upon: (a) your interaction with the Mobile App, our Websites, content, or other Services; (b) information from activities such as your purchase and transaction history, including information about you obtained through MyWhataburger Rewards; and (c) notifications, ads, offers, or new Whataburger location announcements or Whataburger events based upon geolocation data collected from your computer or from your mobile device. Such information allows us to provide you with more useful and relevant notifications, ads, offers, or announcements. We disclose such information to Suppliers we use for delivery of notifications, ads, offers, or announcements.
6. Cross-Device Technologies
We and our Suppliers may use collected information to establish connections among related web-browsers and devices (such as smartphones, tablets, and computers) for targeted advertising, analytics, attribution, and reporting purposes. We and/or our Suppliers may match your browsers or devices if you log into the same online service on multiple devices or if your devices share similar attributes that support an inference that they are used by the same person or household. This means that your online behavior (information about your activity on websites or apps on your current browser or device and your device’s geolocation, which may include specific longitude and latitude) may be combined with information collected from your other browsers or devices. For example, our Suppliers may use this information to deliver an ad on your tablet or smartphone, to limit the number of times you see an ad across your devices, and to help measure the effectiveness of advertising campaigns across devices.
7. Third-Party Sites and Interactive Features
The Services may contain links to various other websites that are not maintained by or related to Whataburger. We are not responsible for the privacy policies, practices, or the content of websites linked from our Services. The links are accessed and used at your own risk, and Whataburger makes no representations or warranties about the content, completeness, or accuracy of these links, or the sites hyperlinked to or from the Services. Third-party websites that are accessible by hyperlinks from the Services may use cookies and other tracking technologies that are not subject to this Privacy Policy. You should consult the other websites’ privacy policies, terms and conditions, and other policies to understand their privacy practices. Whataburger does not implicitly endorse third-party sites hyperlinked to the Services.
We may also provide certain functionalities that interact with third-party apps, tools, widgets, and plug-ins on our Services (“Social Features”), such as Facebook “Like” buttons, which may also use automated methods to collect information about how you use these features. These Social Features include enabling you to send content such as contacts and photos between the Services and another service; “liking” or “sharing” content; and otherwise connecting our Services to another service (e.g., to pull or push information to or from our Services). If you use Social Features, information you post or provide access to may be publicly displayed by the social media service that you use. Similarly, if you post information on a social media service that references the Services (e.g., by using a hashtag associated with Whataburger), your post may be used on or in connection with the Services or otherwise by Whataburger and/or our affiliates. Both Whataburger and the social media service may have access to certain information about you and your use of the Services and any social media service. These organizations may use your information in line with their own privacy policies and you are encouraged to check your privacy settings within such third-party platforms and services.
We may also use Suppliers to provide interactive features on the Services. Your use of these features is voluntary, and we may retain the information you submit through these features. As an example, we may provide an interactive chat feature to assist you with customer service purposes. Once you have interacted with the chat (either with a virtual or live agent) the records of that chat may be retained and kept as a transcript. By using these features, you understand that our vendors may process the Personal Information obtained through the feature to provide the service on our behalf.
8. Sweepstakes, Contests, and Promotions
If you choose to enter a Whataburger sweepstakes, contest, or other promotion (each, a “Promotion”), including Promotions jointly sponsored or offered by third parties, you may be required to submit certain Personal Information. If you voluntarily choose to enter a Promotion, your information, including Personal Information, may be disclosed to us, our co-sponsors, our Suppliers, and other third parties, including for administrative purposes and as required by law (e.g., on a winners list). By entering, you must agree to the official rules that govern that Promotion, which may include consent to additional or differing data practices from those contained in this Privacy Policy. Please review those rules carefully.
9. Information Security
Whataburger is committed to the protection of the information covered by this Privacy Policy, and uses reasonable measures to maintain appropriate physical, electronic, and managerial procedures and safeguards to prevent unauthorized access, use, or disclosure of the information we collect via the Services. However, no method of electronic transmission or storing of data is guaranteed to be 100% secure, and therefore, we do not guarantee that the information collected will never be accessed, used, or disclosed in a manner that is inconsistent with this Privacy Policy.
10. Your Choices, Changing Your Information, and Deleting MyWhataburger Accounts
We provide you with the ability to review or change certain elements of your Personal Information and make certain choices about how we use or disclose Personal Information. You may review, change, or exercise choices regarding certain of your Personal Information as follows:
- To update, verify, or delete certain of your Personal Information, please edit the applicable MyWhataburger Account. Note that not all fields are able to be changed using the self-service settings. If you are unable to update your Personal Information using the self-service settings, please contact Customer Care at https://whataburger.com/contact-us.
- To opt out of informational or promotional e-mail messages from us, click the “Unsubscribe” link on the e-mail you received. Please note that even if you opt out of receiving promotional communications, we may continue to send you non-promotional e-mails, such as those about your account, servicing, or our ongoing business relations.
- To opt out of Cookies, use the “Your Privacy Choices” link in the Website footer or Mobile App settings. For more options, see the “Cookies and Other Tracking Technologies” section above.
- To stop sharing your geolocation data with us, you may adjust your location preferences on your computer, browser, or mobile device.
- To delete your MyWhataburger Account, please select the “Delete Account” function either in the Whataburger Mobile App or the applicable Whataburger Website.
- To delete the Whataburger Mobile App, uninstall the application from your mobile device. Note that uninstalling the Mobile App will not delete the Personal Information we have already collected nor delete your MyWhataburger Account.
- Other choices may be available within your MyWhataburger Account page or presented to you in certain communications.
In some cases, information may not be immediately updated or deleted, subject to retention for MyWhataburger Account program administration, dispute resolution, troubleshooting, and other legal or business reasons, including within our Suppliers’ records. Your historical MyWhataburger Account usage information may remain in our or our Suppliers’ records.
11. Additional State Privacy Disclosures
This section provides additional information for residents of certain states that provide privacy rights to consumers, including California, Colorado, Tennessee, and Texas (each, a “Covered State”).
a. Sensitive Personal Information. Some Personal Information we collect may be considered sensitive under certain Covered State laws and the scope of Sensitive Personal Information changes depending on the Applicable State law. We process the following categories of Sensitive Personal Information: ethnicity and precise geolocation.
b. Selling and Sharing for Targeted Advertising. We do not sell Personal Information in exchange for monetary compensation. We may, however, share Personal Information with certain third parties (such as online advertising services) or allow them to collect Personal Information via automated technologies on our Website and Mobile App for targeted advertising purposes (“Targeted Advertising”). This activity may be considered a sale of Personal Information under certain Covered State laws. As permitted by Covered State laws, we may sell or share for Targeted Advertising the following categories of Personal Information: Identifiers and Personal Records, Internet or Other Electronic Network Activity, Geolocation Data, and Inferences. We sell and/or share this Personal Information with advertising, analytics, and social media Suppliers for marketing, advertising, certain types of analytics, and similar purposes and to show you relevant advertisements while you browse the internet or use social media. Your text message opt-in information and consent will not be sold, rented, or shared with third parties for their marketing purposes.
c. Personal Information Retention. We retain the categories of Personal Information we collect for as long as is necessary for the purposes described in this Privacy Policy or otherwise authorized by law. This generally means that we maintain Personal Information for as long as one of the following circumstances apply: the Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the Personal Information; the Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected; the Personal Information is reasonably required to protect or defend our rights or property; or we are otherwise required or permitted to keep the Personal Information by applicable laws or regulations. Where Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires.
d. Privacy Rights. If you are a resident of California, Colorado, Tennessee, Texas, or another Covered State, you have the right to:
- Confirm whether we are processing your Personal Information; access your Personal Information; and obtain certain information about our processing of your Personal Information, including the categories and specific pieces of Personal Information we have collected about you.
- Obtain a copy of Personal Information you provided to us in a portable format.
- Request a list of specific third parties which we may have disclosed your Personal Information (if you are a resident of Connecticut, Minnesota, or Oregon) or request a list of categories of third parties to which we may have disclosed your Personal Information (if you are a resident of Maryland).
- Request correction of inaccuracies in your Personal Information.
- Request deletion of your Personal Information.
- Opt out of sales of your Personal Information and sharing your Personal Information for Targeted Advertising.
We do not use automated decision-making technologies or profile consumers in furtherance of decisions that produce legal effects or effects of similar significance or for purposes to which the rights to opt out of or access automated decision-making technologies apply under Covered State privacy laws. We do not use or disclose sensitive Personal Information for purposes to which the right to limit use and disclosure applies under California law. We do not collect, use, or sell Personal Information for the purpose of training large language models.
e. How to Submit a Request. Residents of California, Colorado, Tennessee, Texas, and other Covered States may submit an access, correction, or deletion request by clicking here and may submit a request to opt out of sale or targeted advertising by clicking the “Your Privacy Choices” link in our Website footer or Mobile App settings.

- For Androids, the Your Privacy Choices link can be located by selecting ? hamburger menu (three horizontal bars icon) ? Your Privacy Choices.
You also can opt out of Targeted Advertising by broadcasting the Global Privacy Control signal from a supported browser. Requests sent using the Global Privacy Control will apply to the browser from which they are submitted. For more information about the Global Privacy Control, please visit globalprivacycontrol.org.
When your Personal Information is processed based on your consent, you may withdraw your consent at any time by e-mailing us at Privacy@wbhq.com and indicating the processing activity for which you would like to withdraw your consent. Such withdrawal will be applied to any future processing of your Personal Information that is based on such consent.

f. Verifying Requests. Before processing your access, deletion, or correction request, we will take reasonable steps to verify your identity. We may require you to verify your e-mail address and/or provide any of the following information: name, zip code, and if you have a Whataburger account, Rewards ID / Rewards Number and loyalty account balance.
g. Appealing Requests. You may appeal our decision with respect to a request you have submitted by e-mailing Privacy@wbhq.com and indicating that you would like to submit an appeal.
h. Non-Discrimination. If you choose to exercise any of your rights described above, you have the right to not receive discriminatory treatment by us.
i. Financial Incentives and Loyalty Programs. We may offer you certain financial incentives and loyalty program benefits (“Incentive Program”) permitted under applicable law that can result in different prices, rates, or quality levels. We provide notice below for each Incentive Program listed, or we will provide notice in connection with the offer for the particular Incentive Program. Participation in an Incentive Program requires you to sign up for or opt in to the program, which you may withdraw from at any time. We may add or change Incentive Programs and their terms by posting notice on the program descriptions below or within the offer to participate, so please check them regularly. The financial incentive we offer through each Incentive Program is reasonably related to the value of the participant’s data. We have made a good faith estimate of the value of the participant’s data based on relevant expenses related to the collection and retention of Personal Information as part of each Incentive Program.
The “Selling and Sharing for Targeted Advertising” section above identifies the categories of Personal Information that we may collect, sell, share, or otherwise process for Targeted Advertising through the Incentive Program.
j. MyWhataburger Rewards™ Program Notice: Our MyWhataburger Rewards™ Program (“Rewards Program”) offers members benefits such as free Whataburger products, points to redeem for Whataburger rewards, and chances to win exclusive experiences, among other benefits described in more detail in our Rewards Page and the MyWhataburger Loyalty and Rewards Program Terms. We collect identifiers and personal records (including name, e-mail address, and birth date), commercial and transaction information (including information about the products you buy and loyalty or rewards activity), account information, internet or other electronic network activity information, and geolocation data to facilitate our operations, track points and other rewards, and provide you with benefits. We disclose Personal Information collected through the Rewards Program to service providers that help us operate the program, including Xenial/Beanstalk, mParticle, Stitch, Radar, Snowflake, Bounteous, Google Analytics, and LiveRamp. Whataburger accountholders are automatically signed up to earn points when you make a purchase. Redeeming rewards is entirely optional but is subject to additional terms and conditions and exclusions. You may opt in by creating an account and choosing to participate in optional activities that provide associated benefits. You may withdraw from the Rewards Program at any time by deleting your Whataburger account using your self-service settings or contacting Whataburger Customer Care using the information at https://whataburger.com/contact-us.
k. Additional Disclosures for California Residents. The disclosures that describe how and why we collect, use, and disclose Personal Information also describe how we have collected, used, and disclosed Personal Information in the preceding 12 months.
